WHEREAS a Constituency Boundaries Commission was appointed on 4 June 2009 under section 53 of the Constitution of Bermuda;
AND WHEREAS the Commission, under section 54(1) of the Constitution, submitted its report (“the Report”) to the House of Assembly on 21 May 2010, making recommendations for the alteration of constituency boundaries;
AND WHEREAS, although the modifications set out in paragraph 3 of this Order (correcting minor inaccuracies in the definition of certain constituency boundaries) were approved by the Commission, the modifications were inadvertently not included in the Report;
AND WHEREAS the House of Assembly on 26 November 2010 approved a draft of this Order, being a draft designed to give effect to the recommendations of the Report with the modifications set out in paragraph 3;
AND WHEREAS it is expedient to confirm and give legal effect to that draft;
NOW THEREFORE, in exercise of the power conferred by section 54(6) of the Constitution of Bermuda, the Governor makes the following Order:
Citation
1.- This Order may be cited as the Constitution of Bermuda (Constituency Boundaries) Order 2010.
Commencement
2.- This Order comes into operation upon the next dissolution of the Legislature.
New constituency boundaries
3.- The boundaries of the constituencies into which Bermuda is divided are those defined in the Schedule to the Report of the Constituency Boundaries Commission, submitted to the House of Assembly on 21 May 2010, with the following modifications :
(a) in the definition of Constituency 4 ..- St. George’s South, delete “Castle Island, Charles’ Fort, Rushy Island,” (in the fourth from last and third from last lines);
(b) in the definition of Constituency 8 ..- Smith’s South, delete “of McGall’s Bay Road and” (in the fourth from last line) and substitute “with”;
(c) in the definition of Constituency 9 ..- Smith’s West :
(i) delete “McGall’s Bay Road; thence South-East following” (in the seventh line); and
(ii) immediately after “Spittal Pond Nature Reserve” (in the eighth line), insert “; thence South along the Western boundary of Spittal Pond Nature Reserve”;
