Adopted in Helsinki, 11 December 2002 (amendments 28.1.2003)
The Ministry of Transport and Communications has, under section 8 of the Act on the Grounds for Payments to the State issued on 21 February 1992 (150/1992), as amended by Act 384/1994, under section 31 of the Act on Postal Services (313/2001), and under section 26 a of the Act on the Protection of Privacy in Telecommunications and Data Security of Telecommunications Operations (565/1999), as amended by Act 681/2002, enacted as follows:
1. Scope of application
This Decree specifies the services of the Finnish Communications Regulatory Authority subject to a fee and the grounds for the determination of such fees as well as public-law services subject to a fixed fee.
2. Public-law services subject to a fixed fee
The public-law services subject to a fee referred to in section 6, paragraph 2 of the Act on the Grounds for Payments to the State, for which the Finnish Communications Regulatory Authority shall charge the fixed fees laid down in section 6 and sections 9 – 17 a of this Decree shall be:
1) the granting of the right to possess and use a radio transmitter subject to a licence other than one referred to in section 4;
2) supervision of another radio transmitter not subject to a licence than one referred to in section 9, paragraph 3;
3) type approval or other approval of radio equipment;
4) inspection of a radio station;
5) qualification and competence examination of radiocommunications;
6) qualification and competence certificate for radiocommunications;
7) authorization of a telecommunications contractor;
8) supervision of telecommunications contracting;
9) the right to use a digit prefix of a telecommunications network and a subscriber number;
10) the granting, change or transfer of a network code or other code of a data network;
11) the maintenance of the right of use of a network code or other code of a data network.
12) the registration of certification authorities providing qualified certificates related to electronic signatures. (28.1.2003/59)
3. Public-law services at cost price
Public-law services for which the Finnish Communications Regulatory Authority shall charge a fee at the cost-price of the service shall be the following services:
1) protection of a radio receiver from interference;
2) re-inspection of a telecommunications network constructed by a telecommunications contractor;
3) spectrum planning relating to the military defence of the country;
4) supervision of the postal services of a postal agency;
5) co-ordination of a satellite system implemented by the International Telecommunication Union or another international organisation;
6) supervision of information security breaches of telecommunications and data systems;
7) designation of the notified bodies assessing the creation devices of electronic signatures. (28.1.2003/59)
4. Services for a fee other than at cost-price
The public-law services for which the Finnish Communications Regulatory Authority shall charge a fee different from the cost price of the service referred to in section 6, paragraph 3 of the Act on the Grounds of Payments to the State, shall be the following services:
1) authorizing the possession and use of radio transmitters subject to a licence and used at the base stations of a mobile network;
2) authorizing the possession and use of radio transmitters subject to a licence and used at the base stations of a paging system in public telecommunications;
3) authorizing the possession and use of radio transmitters subject to a licence and used at the base stations of the TFTS system;
4) authorizing the possession and use of radio transmitters subject to a licence and used for a wireless local loop operating in a frequency band specified by the Finnish Communications Regulatory Authority;
5) authorizing the possession and use of radio transmitters subject to a licence and used for the base stations of the authority radio network (VIRVE);
6) authorizing the possession and use of radio transmitters subject to a licence and used for the radio sonde systems in meteorological aids; as well as
7) authorizing the possession and use of radio transmitters subject to a licence and used at the base stations of the GSM-R radio system.
5. Services subject to a feed based on business principles
The services referred to in section 7 of the Act on the Grounds of Payments to the State which the Finnish Communications Regulatory Authority shall price using business principles shall be the following services:
1) services of a notified body relating to common European conformity assessment of telecommunications terminal equipment or radio equipment;
2) a radio amateur code of one’s own choice;
3) printed material not forming part of information services causing minor expenses;
4) training not forming part of information services causing minor expenses;
5) photocopy, electric recording or other copy or an extract or duplicate from a document in the possession of the Finnish Communications Regulatory Authority;
6) dispatch of a document where the costs are not included in the fee to be charged for another service under this Decree; as well as
7) other service ordered from the Finnish Communications Regulatory Authority.
6. Licence fees of radio transmitters
The right to possess and use a radio transmitter subject to a licence shall be subject to an annual fee as follows:
1) amateur radio transmitters or a repeater meant for forwarding voice radio programmes (max power 0.5 W) 16.00 euros
2) a land mobile VHF/UHF transmitter, a ship or aircraft VHF/UHF station or a transmitter for telecommand or control or other telemetry than a radio transmitter for the radio sonde systems in meteorological aids 18.50 euros
3) a ship earth station in the maritime mobile satellite service or a ship MF/HF station or an aircraft earth station in the aeronautical mobile satellite service or an aircraft MF/HF station 40.35 euros
4) VHF/UHF beacon 60.55 euros
5) a transmitter, not subject to coordination, of an earth station in the fixed satellite service or a fixed VHF/UHF transmitter in the land mobile service, excluding a base station of a public mobile network or a paging system in the public telecommunications or a ground station of the TFTS system or the basestation transmitter of an authority radio network (VIRVE) or the base station transmitter of the GSM-R radio system 72.30 euros
6) a low-power broadcast transmitter (max power 300 W), an LF/MF beacon or a radio link transmitter other than a transmitter of a wireless local loop operating in a band specified by the Finnish Communications Regulatory Authority 107.65 euros
7) a fixed MF/HF transmitter, medium or high-power broadcast transmitter (power more than 300 W) or other than a ship or aircraft radar transmitter 156,40 euros
8) a transmitter, to be coordinated, of an earth station in the fixed satellite service 178,30 euros
The right to possess and use a radio transmitter subject to a licence other than one referred to in paragraph 1 or section 7 shall be subject to a licence fee corresponding to the licence fee collected for the nearest equivalent under paragraph 1.
7. Spectrum fees
The right to possess and use licensed radio transmitters of the base stations of a public mobile network, a wireless local loop operating in a frequency band specified by the Finnish Communications Regulatory Authority, a paging system used for public telecommunications, the TFTS system or an authority radio network (VIRVE) or the GSM-R radio system or radio transmitters used for the radio sonde systems in meteorological aids shall be subject to an annual spectrum fee calculated in accordance with the following formula:
1) public mobile network K1* K2* K3* (frequency band/25 kHz) *1,896.30 euros
2) wireless local loop K1* K2* (frequency band/25 kHz) *1,896.30 euros
3) paging system K1* K2* (frequency band/25 kHz) *1,896.30 euros

A frequency band is the total amount of sub-bands allocated to the radio system.
K1 is a frequency band coefficient whose size is determined by the frequency band assigned to the licence holder. The frequency band coefficients are the following:

K2 is a coverage area coefficient determined by the geographical area of the radio system assigned to the licence holder.
If the right of use covers the whole country, the coefficient shall be 1. The coverage area coefficient of a restricted right of use area is determined as the sum total of the right of use area and the guard zone determined below divided by the whole area of Finland.
K3 is a starting coefficient and its size shall depend on the starting date of the right to use the frequencies assigned to the radio system of the licence holder. The starting coefficients shall be:

K4 is a separate-network coefficient and its size shall be determined separately on the basis of the purpose of each separate network. The separate-network coefficients shall be the following:

The guard zone referred to in paragraph 4 shall be a 20-kilometer wide zone around the right of use area assigned to the radio system. However, no guard zone shall exist in a sea area or in an area crossing the border. Nor shall an area partly covering a right of use area assigned to a holder of a licence for another similar radio system be considered a guard zone if the use of the frequencies is coordinated between the licence holders. The guard zone shall not be taken into consideration when determining the coverage area coefficient of the radio system of a local loop.
The spectrum reservation granted for spectrum bands needed for the use of licensed radio transmitters of the base stations of a radio system of a local loop shall be subject to a spectrum fee on the same grounds as the right to possess and use licensed radio transmitters of the base stations of the radio system. The size of the spectrum fee to be collected shall be the annual spectrum fee multiplied by the ratio of the number of beginning months of the period of validity of the spectrum reservation and 12.
The same starting coefficient that is used for a frequency spectrum and right of use area already in use shall be applied to changes in the frequency spectrum and right of use area assigned to a licence holder.
8. Spectrum planning charge
The Defence Forces shall be charged an annual spectrum planning fee for the spectrum planning relating to the national military defence on the basis of the average working hour costs incurred by the production of the service and the number of annual working hours spent on the service. The annual working hour cost shall be 98.45 euros.
9. Control fees of radio transmitters
The following control fees shall be charged from the manufacturer or importer of a radio transmitter, not subject to a licence, that is intended to be sold or used in Finland and which is manufactured in, or customs cleared for, Finland or otherwise imported into Finland:
1) a radio transmitter with a maximum radiated power of 10 mW or telecommand equipment for a scale model 3.35 euros
2) a radio transmitter with a radiated power exceeding 10 Mw 8.40 euros
Without prejudice to the provisions of paragraph 1, the holder of a radio transmitter not subject to a licence shall be charged a control fee if a control fee has never been paid for a single transmitter in use or if the earlier approval mark of the Finnish Communications Regulatory Authority has been lost, damaged or otherwise become unidentifiable.
Without prejudice to the provisions of paragraph 1, no control fee shall be charged for the following radio transmitters not subject to a licence:
1) a mobile transmitter of a public telecommunications network or a radio transmitter of a network other than the radio transmitter of its base station and subject to a licence;
2) subscriber equipment of a wireless local loop operating in a frequency band specified by the Finnish Communications Regulatory Authority; as well as
3) a radio transmitter that has, in a common European procedure complying with the decisions and recommendations of the European Radio Committee (ERC) separately implemented in Finland, been ensured to conform to the specifications set for it and which has been marked in the manner specified in the said procedure.
10. Approval fees of radio equipment
The following approval fees shall be charged for a type approval of radio equipment or a separate approval of an individual piece of radio equipment:
1) national type approval of radio equipment; 285.90 euros
2) national type approval of a radio equipment family or demanding and timeconsuming national type approval; 571.85 euros
3) approval of an individual piece of radio equipment; 84.10 euros.
If the fixed approval fee of a service laid down in paragraph 1 and based on the average costs incurred through the production of the service is, in an individual case, unreasonably high or low compared to the costs incurred by the Finnish Communications Regulatory Authority for the type approval or other approval, the cost price of the service shall be charged instead of the fixed approval fee.
11. Inspection fees of radio station
The initial inspection or alteration inspection of radio equipment or a radio station shall be subject to an inspection fee of 840.95 euros.
12. Examination fees of radiocommunications
The following examination fees of radiocommunications shall be charged for each attendance:
1) General Operator’s Certificate GOC or General Certificate of Proficiency in Radio Telephony; 75.70 euros
2) Restricted Operator’s Certificate ROC or Long-Range Certificate LRC or Restricted Radio Telephone Operator’s Certificate; 67.30 euros
3) Short-Range Certificate SRC; 45.40 euros
4) GOC or ROC competence examination; 37.85 euros
5) a module of a radio amateur examination; 12.95 euros.
An examination fee of 50 % of the corresponding fee for the whole examination shall be charged for attendance at a part of an examination
referred to in subparagraphs 1 – 4 for each attendance.
An examination fee equal to the fee for the nearest corresponding examination referred to in paragraph 1 shall be charged for a full or partial qualification examination other than one referred to in paragraph 1.
13. Fees for radiocommunication certificates
A fee of 43.75 euros shall be charged for a certificate issued for the completion of an examination referred to in section 12, paragraph 1, subparagraphs 1 – 3 and 5.
A fee of 28.60 euros shall be charged for a certificate issued for the completion of a competence referred to in section 12, paragraph 1, subparagraph 4.
14. Registration fees of telecommunications contracting
A registration fee of 50 euros shall be charged for the authorization of a person or an undertaking to perform telecommunications contracting and for
amendment of such authorization.
15. Supervision fees of telecommunications contracting
A telecommunications contractor shall be charged the following annual supervision fees of telecommunications contracting:
1) telecommunications contractor authorised to perform work on customer premises telephone networks; 240 euros
2) telecommunications contractor authorised to perform work on customer premises Master Antenna Television systems; 240 euros
3) telecommunications contractor authorised to perform work on customer premises telephone networks and customer premises Master Antenna Television systems; 400 euros
4) telecommunications contractor authorised only to perform work on customer premises telecommunications networks in the contractor’s own possession; 20 euros
5) telecommunications contractor authorised to perform work on a separate network specified in the authorization decision; 20 euros.
The supervision fee to be charged a telecommunications contractor authorised to perform one specific assignment only shall be 20 euros.
16. Numbering fees of a telecommunications network
A telecommunications operator or the holder of a service number or data network code shall be charged the following annual numbering fees for the right to use a digit prefix or a subscriber number:
1) subscriber number fee:
the number of a public fixed telephone network 0,36 euroa/ liittymä a nation-wide portable number of a public fixed telephone network siirrettävä numero 0,72 euroa/ liittymä the number of a public mobile telecommunications network0,36 euroa/ liittymä
2) carrier access code fee:
a 3-digit long-distance traffic code 35,000 euros
a 4-digit long-distance traffic code 7,000 euros

a 3-digit international traffic code 70,000 euros
a 4-digit international traffic code 14,000 euros
a 5-digit international traffic code 2,800 euros
a 5-digit general carrier access code 4,200 euros
3) a prefix fee of a mobile communications network:
a 3-digit prefix 35,000 euros
a 4-digit prefix 7,000 euros
a 5-digit prefix 1,400 euros
4) a prefix fee of a special-purpose network:
a 3-digit prefix 35,000 euros
a 4-digit prefix 7,000 euros
a 5-digit prefix 1,400 euros
5) a service number fee:
a numbering-area specific service number of 4 digits 1,000 euros
a numbering-area specific service number of at least 5 digits 200 euros
a nation-wide service number of 3 digits 43,000 euros
a nation-wide service number of 4 digits 8,600 euros
a nation-wide service number of 5 digits 1,720 euros
a nation-wide service number of at least 6 digits 344 euros
6) a data network identification code fee (DNIC) 11 350 euroa
7) a fee for a technical telecommunications operator identification code:
an International Signalling Point Code (ISPC) 1,680 euros
a National Signalling Point Code (NSPC) 0.8 euros
a Closed User Group (CUG) code 0.8 euros
a centrex telecommunications operator code 35 euros
a Mobile Network Code (MNC) of a telecommunications operator 340 euros
a Network Colour Code (NCC) of a telecommunications operator 170 euros
8) a fee for a Short Message Service (SMS) number;
a 5-digit SMS number 120 euroa
a 6-digit SMS number 80 euroa
The applicant for a nation-wide portable telephone number shall be charged the following registration fees:
1) granting the right to use 1 – 9 numbers 17 euros
2) granting the right to use 10 – 1000 numbers 50 euros
3) granting the right to use more than 1,000 numbers 170 euros
The subscriber number fee referred to in paragraph 1, subparagraph 1 shall be charged on the basis of the number of subscriptions in the network of the telecommunications operator on the first day of the year for which the fee is charged.
The telecommunications-area specific service-number fee charged in the telecommunications area of Åland shall be one-tenth and in Finland, with the exception of the telecommunications areas of Uusimaa
1, Turku and Pori or Häme, six-tenths of the telecommunications-area specific servicenumber fee laid down in paragraph 1, subparagraph 5.
No service-number fee shall be charged for a public emergency number or other corresponding non-profit service number.
The carrier access code fee, prefix fee of a mobile communications network, prefix fee of a special-purpose network and servicenumber fee charged for the first billing year of the code shall be 50 % of the fees laid down in paragraph 1, subparagraphs 2 – 5.
17. Code fees of data networks
A network identification fee of 53.80 euros shall be charged for the granting, change or transfer of a network identification code of an Internet data network.
An annual maintenance fee of 16.80 euros shall be charged for the right to maintain the network identification code of an Internet data network.
17 a (28.1.2003/59) Registration fees of certification authorities providing qualified certificates related to electronic signature
The registration fee of 3,000 euros shall be charged for the registration of a notification relating to the provision of qualified certificates to the public.
17 b (28.1.2003/59) Designation fees of notified bodies assessing the creation devices of electronic signatures
A designation fee shall be charged from an undertaking which has submitted an application for designation as a notified body in accordance with section 6 of the Act on Electronic Signatures and it shall be determined on the basis of the time spent on the assessment of conformity with the requirements set for notified bodies. The designation fee shall be 70 euros per each hour of work.
18. Supervision fees for breach of information security
Telecommunications operators which have submitted a notification under section 5 of the Telecommunications Market Act or licensed telecommunications operators shall be charged an annual supervision fee for the supervision and other services of the Finnish Communications Regulatory Authority in accordance with section 26 a of the Act on the Protection of Privacy and Data Security in Telecommunications, the amount of which shall be 0.01 % of the annual turnover of the telecommunications subject to a telecommunications notification or licence for the previous financial period, however, at least 500 euros. If the operations of the undertaking terminate in the middle of a calendar year, the supervision fee collected shall not be returned.
If the financial period forming the basis for the determination of the supervision fee differs from a calendar year, the turnover shall be changed to correspond to the turnover of a year by multiplying it by 12 divided by the length of the financial period in months.
The Telecommunications Regulatory Authority shall have the right to obtain the information necessary to determine the size of the fee. If the fee is charged for the first year of operations or if the undertaking has not an adopted financial statement with regard to the public telecommunications carried out by it or if the information submitted by the undertaking is insufficient, the Telecommunications Regulatory Authority may estimate the size of the fee.
19. Supervision fees of postal services
A postal agency shall be charged an annual supervision fee for the supervision of its postal services and the amount of the fee shall be 2.46 pro mille of the annual turnover of the postal services of the postal agency, however, at least 1,681.85 euros.
The turnover referred to in paragraph 1 shall be the actual turnover two years preceding the charging of the fee. Postal services shall refer to postal services belonging to the scope of application of the Act on Postal Services (313/2001).
In the first year of operations, the control fee of a postal agency shall be 1,681.85 euros and in the second year, 8,409.40 euros.
20. Fees charged for rejected applications
The fees referred to in section 10 – 12, sections 14 and 17 of this Decree shall be charged also for decisions rejecting the applications.
21. Entry into force
This Decree shall enter into force on 1 January 2003 and it shall remain valid until the end of the year 2005.
This Decree shall repeal the Decree of the Ministry of Transport and Communications on the Fees of the Finnish Communications Regulatory Authority of 12 December 2001 (1245/2001).
A fee for a service relating to a matter, which has become pending prior to the entry into force of this Decree shall be charged in accordance with the provisions in force upon the entry into force of this Decree.
Measures necessary for the implementation of this Decree may be taken prior to its entry into force.
